By accessing or using the 1OM Virtual Mall platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, users, shoppers, retailers, and others who access the Service.
1OM Virtual Mall is a Canadian digital shopping destination that provides an immersive virtual mall experience representing retailers from all 13 Canadian provinces and territories. The Service includes browsing capabilities, retailer directories, interactive 3D environments, and account management features.
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into a binding contract.
To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
1OM offers three shopper tiers: Free, Pro ($4.99/month), and Elite ($9.99/month). Subscription fees are billed in advance on a monthly basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. All fees are in Canadian dollars and are non-refundable except as required by applicable law.
Retailers may claim and manage virtual storefronts within the 1OM platform. Retailers are responsible for the accuracy of all information displayed in their storefronts, including product descriptions, pricing, and availability. 1OM does not act as a merchant of record for any transactions between shoppers and retailers.
You agree not to use the Service to:
The Service and its original content, features, and functionality are owned by 1OM Virtual Mall Inc. and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, create derivative works, publicly display, or commercially exploit any content from the Service without our prior written consent.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. 1OM DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 1OM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Toronto, Ontario.
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of this page and, where appropriate, by sending you an email notification. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
